{"id":740,"date":"2026-05-28T22:07:27","date_gmt":"2026-05-28T22:07:27","guid":{"rendered":"https:\/\/homebuyerrelocation.com\/?p=740"},"modified":"2026-05-28T22:07:27","modified_gmt":"2026-05-28T22:07:27","slug":"industries-regain-liability-shield-for-emission-violations-under-epa-rule","status":"publish","type":"post","link":"https:\/\/homebuyerrelocation.com\/?p=740","title":{"rendered":"Industries regain liability shield for emission violations under EPA rule"},"content":{"rendered":"<div>\n<div>\n<div>\n<p>The Environmental Protection Agency is withdrawing a Biden-era rule that stripped industries of protection against civil liability and penalties for emergency-related violations of Clean Air Act emission limits.<\/p>\n<p>Read more <a href=\"https:\/\/homebuyerrelocation.com\/?p=738\">DOJ probes billionaire Democrat\u2019s nonprofit that bankrolled sexual assault suit against Trump<\/a><\/p>\n<p>In 2023, the Biden administration removed \u201cemergency affirmative defense\u201d provisions from federal air permitting regulations for stationary sources, known as Title V permits.<\/p>\n<p>Even when operators tried to prevent and mitigate emissions during situations they could not prevent, the EPA said they were still exposed to liability.<\/p>\n<p>Thursday\u2019s move stems from a January court-ordered mandate that reversed the Biden administration\u2019s 2023 Affirmative Defense Rule, requiring the agency to revert to its old framework that distinguishes between liability for noncompliance and noncompliance in extreme circumstances.<\/p>\n<p>A coalition of trade associations that brought the suit argued that removing the defense exposed its members to liability even during genuine, unavoidable emergencies. The court found the rule was \u201cunreasonable and not in accordance with law.\u201d<\/p>\n<p>A slew of environmental groups formally intervened on the EPA\u2019s side when the rule was initially challenged in court in 2023.
